DMCA Policy

Skinny Chicken And Avocado Caesar Salad ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Skinny Chicken And Avocado Caesar Salad website and/or services (the "Service") if such claims are reported to our Designated Copyright Agent identified in the sample notice below.

This policy describes the information that should be present in a DMCA notice, how to submit it, and what happens next. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Filing a DMCA Notice

If you are a copyright owner, or an agent authorized to act on behalf of one, and you believe that material available on our website infringes upon your copyrighted work, please submit a written notification ("DMCA Notice") to our Designated Copyright Agent with the following information:

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to enable us to identify the copyrighted work, such as a URL to the original work, a title, or a registration number.
  2. Identification of the material that is claimed to be infringing: Provide specific information about the location of the allegedly infringing material on our Service, including the URL(s) where it can be found.
  3. Sufficient information to allow us to contact the complaining party: This includes your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA Notice, we will act expeditiously to remove or disable access to the infringing material. We will also notify the alleged infringer of the claim and inform them of their right to file a counter-notification.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a written counter-notification ("Counter-Notice") to our Designated Copyright Agent. Your Counter-Notice must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: Provide the URLs or other identifying information of the material and its location before removal or disablement.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Skinny Chicken And Avocado Caesar Salad may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid Counter-Notice, we will provide a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our discretion.
